The United States Securities and Exchange Commission (SEC) has released clarification concerning the status of liquid staking tokens associated with Ethereum (ETH). According to SEC staff, when these tokens function solely as receipts or representations of staked ETH, rather than incorporating additional features or profit mechanisms, they are not considered securities under current SEC guidelines.
However, the SEC noted there are important conditions to this classification. If liquid staking tokens introduce further elements that could be perceived as investment opportunities or profit-sharing structures, they may fall within the SEC's securities definition and thus become subject to stricter regulations. This distinction is significant for staking service providers, DeFi protocols, and participants choosing between native staking and liquid staking options.
Industry observers are assessing how the new guidance might impact existing projects and staking practices, especially as the regulatory landscape continues to evolve.
